Terms & Conditions

These Terms and Conditions govern your access to and use of the FlightNerve flight data API, website and developer console. Please read them carefully — by creating an account or making an API request, you agree to them.

1. Acceptance of terms

This is a legal agreement between you (the "Customer", "you") and FlightNerve ("FlightNerve", "we", "us"). By registering for an account, generating an API key, or sending any request to the FlightNerve flight data API, you confirm that you have read, understood and agree to be bound by these Terms and Conditions and our Privacy Policy. If you are entering into this agreement on behalf of a company or other legal entity, you represent that you have the authority to bind that entity.

If you do not agree with these terms, do not create an account or use the service.

2. Definitions

  • Service — the FlightNerve flight data API, its endpoints, the website, documentation and the developer console.
  • API key — the unique credential issued to your account and used to authenticate requests.
  • Call / request — a single HTTP request to an API endpoint.
  • Credit — the unit consumed by a successful call, as described in section 6 and on the pricing page.
  • Flight data — the operational information returned by the Service: flight status, live aircraft position, schedules, routes, aircraft, airports and airspace.

3. The service

FlightNerve provides a real-time flight data API. A single request can return a flight's live status, position, schedule, route and aircraft, plus airport, airspace, monitoring and webhook capabilities, in a structured JSON response. The endpoints, parameters and response formats are described in the API documentation, which forms part of these terms.

Flight data is aggregated from multiple upstream sources and derived signals. It is provided for informational and operational purposes. We work to keep it accurate and fresh, but we do not originate primary air-traffic-control data, and coverage or timeliness may vary by region, carrier and flight phase.

FlightNerve is a flight-operations data product. It is not a booking, ticketing or fares service, and it does not hold passenger or reservation records.

4. Accounts & API keys

To use the Service you must create an account and generate an API key. You are responsible for keeping your key confidential and for all activity that occurs under your key. Your key travels as part of the request; keep it server-side and never expose it in public client code or repositories.

You agree to provide accurate account information and to keep it current. You must notify us promptly at api@flightnerve.com if you believe your key has been compromised. We may rotate or revoke a key that appears to be leaked or abused.

5. Acceptable use

You agree not to, and not to permit any third party to:

  • Exceed, circumvent or interfere with rate limits, credit accounting or other technical controls;
  • Share, resell, sub-licence or redistribute raw API responses as a competing bulk data feed or database;
  • Use the Service to build a product whose primary purpose is to replicate or replace the Service;
  • Reverse engineer, scrape around, or attempt to derive the Service's internal sources or methods;
  • Use the Service for any unlawful purpose, or in violation of any applicable aviation, export, sanctions or data-protection law;
  • Transmit malware, attempt to gain unauthorised access to the Service, or disrupt its integrity or performance;
  • Misrepresent the source of the data or imply endorsement by FlightNerve without written permission.

Reasonable caching of responses within your own application is permitted and encouraged. You may display flight data to your end users within your own product, provided you do not offer it as a standalone data feed.

6. Credits, plans & billing

Access is metered in credits. Unless stated otherwise on the pricing page:

  • One successful call consumes one credit. A multi-leg lookup consumes one credit per leg returned.
  • Flight monitoring is charged at a higher rate reflecting its ongoing nature, as shown at the point of use and in the documentation.
  • An empty live-position response (for example, when the aircraft is not airborne) is free, and errors are not charged.
  • New accounts start on a free tier with a fixed allocation of credits and no credit card required.

Paid plans are billed on a usage basis. Fees are exclusive of taxes, which you are responsible for where applicable. We may change pricing prospectively; changes will be published on the pricing page and, for material changes, notified to account holders in advance. Credits have no cash value and are non-transferable.

7. Data, ownership & licence

As between you and us, FlightNerve and its licensors own all rights in the Service, its software, the aggregated data and its presentation. We grant you a non-exclusive, non-transferable, revocable licence to access the Service and use the flight data within your own applications during the term of this agreement, subject to these terms.

You retain ownership of your own application, content and end-user data. You grant us the limited right to process request metadata (such as endpoints called and timestamps) to operate, secure, meter and improve the Service, as described in our Privacy Policy.

8. Availability & support

We aim for high availability and resilient infrastructure designed to keep serving through upstream issues, and we publish live status at the API status endpoint. However, the Service is provided on an "as available" basis. We may perform maintenance, and upstream outages can affect coverage or freshness. Support is available by email at api@flightnerve.com; response times depend on your plan.

9. Warranties & disclaimers

The Service and all flight data are provided "as is" and "as available", without warranties of any kind, whether express, implied or statutory, including any implied warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement. FlightNerve does not warrant that the data is error-free, complete, uninterrupted, or suitable for safety-critical, navigational, or life-critical decision-making. You must not rely on the Service as a sole source for any decision where inaccuracy could cause harm.

10. Limitation of liability

To the maximum extent permitted by law, FlightNerve shall not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, revenue, data or goodwill, arising out of or related to your use of, or inability to use, the Service. Our total aggregate liability arising out of or related to these terms shall not exceed the greater of the amounts you paid to us in the three (3) months preceding the event giving rise to the claim, or one hundred US dollars (USD 100). Nothing in these terms excludes liability that cannot be excluded under applicable law.

11. Suspension & termination

You may stop using the Service and close your account at any time. We may suspend or terminate your access, with or without notice, if you breach these terms, use the Service in a way that risks harm to the Service or others, or fail to pay amounts due. We may also suspend access temporarily to protect the security or integrity of the Service. On termination, your licence ends and you must cease using the Service and delete any cached data beyond what is permitted for your own historical records.

12. Changes to these terms

We may update these Terms and Conditions from time to time. When we make material changes, we will update the "Last updated" date above and, where appropriate, notify account holders. Your continued use of the Service after changes take effect constitutes acceptance of the revised terms.

13. Governing law

These terms are governed by and construed in accordance with the laws of the jurisdiction in which FlightNerve is established, without regard to conflict-of-laws principles. The courts of that jurisdiction shall have exclusive jurisdiction over any dispute arising out of or in connection with these terms, subject to any mandatory consumer-protection rights available to you locally.
